The petition, entitled Karan Johar c. Ashok Kumar / John Doe & Ors, comes shortly after similar victories by Aishwarya Rai Bachchan and Abhishek Bachchan, who both obtained judicial orders protecting their names and images against exploitation.

During the hearing on Monday, Rao said that Johar’s photographs were being downloaded and traffic on various online platforms, certain social media pages even under his name. According to Rao, Johar has the right to decide how and where his character is used commercially. He stressed that the filmmaker’s decision not to act before did not give other cutlery the permission to exploit his identity.

On behalf of Meta Platforms, which owns Instagram, Facebook and Whatsapp, Advocate Varun Pathak warned against a scanning command. He argued that many of the good messages were ordinary comments or jokes made by fans, not defamatory or malicious content. A general injunction, noted Pathak, could open the door to excessive litigation, the daily interactions of the trailled fans in court.

Judge Manmeet Pritam Singh Arora observed that the court should carefully distinguish the denigration, the memes, the content of the fans and the outright commercial exploitation. The judge said that all fan page could not be ordered to close or remove offline. Instead, the court asked the Johar’s team to specifically identify accounts or websites abusing their character for lucrative.

The court said that he could make targeted withdrawal orders against such offenders, while allowing Johar to return to court or approach platforms such as Meta in the event of future violations. The case was registered for a more in -depth exam on September 15.

If it is granted, Johar’s petition would further strengthen the growing legal trend among Bollywood celebrities to protect its image rights against unauthorized use on the digital market and goods.
