Jennifer Lopez struck with proceedings in double copyright
On Saturday, May 17, photographer Edwin Blanco and the Photo Backgrid USA agency filed two federal proceedings against Jennifer Lopez.
They claim co -owners of the images of Lopez standing outside the Amazon MGM Studios X Vanity Fair party at the Marmont bar in Los Angeles on January 4, the day before the Golden Globe Awards.
According to lawyer Peter Perkowski, representative Blanco and Backgrid, Lopez published the photos the next day, January 5, in Instagram and X without authorization. The alleged copyright violation has sparked a wave of republication by pages of fans and fashion brands.

“The unauthorized use of images of Ms. Lopez is commercial in nature, intended for self-promotion,” wrote Perkowski by Display panel. “For example, Ms. Lopez used the images to highlight the creator of his clothes and jewelry, taking advantage of the advertising of the event to promote his fashion affiliations and his brand partnerships.”

Jennifer Lopez’s team would have retained from the verbal agreement

Perkowski revealed that Backgrid and Blanco contacted the Lopez team the week after the alleged offense to tackle the situation.
The discussions would have gone well and the parties verbally accepted a financial settlement. However, the Lopez team has never finalized the agreement in writing or paying payment.
The proceedings also stressed that this is not the first time that Lopez has faced similar claims.
In 2019, she was continued for publishing a photo of paparazzi featuring and her boyfriend then, Alex Rodriguez.
This case, also managed by Perkowski, ended with a voluntary dismissal in 2020.

“This prior dispute has placed Ms. Lopez in opinion concerning the legal requirements and the potential consequences associated with the use of images protected by copyright without appropriate authorization,” wrote Perkowski. “Despite this, Ms. Lopez continued to engage in similar conduct, demonstrating a deliberate contempt for the copyright of Backgrid thanks to a model of behavior which undermines the rights of content creators.”

Lopez is not the first celebrity to be prosecuted for having published their image

The complainants accused Jennifer Lopez of voluntary copyright violation, which could lead to damages up to $ 150,000 per image.
If the trial succeeds, the actress should pay $ 300,000 to publish her own image.
Lopez representatives did not respond to the trial on Monday.
Fans may find strange that celebrities are prosecuted in their photos, but the law is on the side of the applicant.
Stars like Miley Cyrus, Justin Bieber and Dua Lipa have all faced similar proceedings in recent years.
What does the law say?

Under copyright law, the photographer, not the person in the photo, holds the rights of an image.
This means that celebrities can be continued to publish photos of paparazzi of themselves on social networks without authorization.
Even if celebrities are the only subject of the photo, they have no legal right to use it without license. Therefore, taking or publishing such images without consent is considered to be a violation of copyright.
In addition, being in a public place does not exercise someone to photograph, nor gives it control of the image.
If a counterfeit is proven, celebrity can have real or statutory damage, up to $ 150,000 per photo.
Most of the cases, however, settled amicably for smaller amounts.
