Details of Kristy Scott’s petition seeking divorce from Desmond Scott reportedly revealed

On Tuesday, January 13, US Weekly released an exclusive report revealing additional details included in Kristy Scott’s divorce filing. According to the media, in her file filed on December 30, 2025, Kristy claimed that her ex-husband “committed adultery”.

Additionally, she reportedly noted that their marriage had become “unbearable due to discord or personality conflicts.” Thus, it “destroys the legitimate purposes of the marital relationship and prevents any reasonable expectation of reconciliation,” Kristy allegedly claimed.

Additionally, Kristy apparently didn’t note any additional information about Desmond’s alleged infidelity. US Weekly notes that the state of Texas considers adultery to be “the voluntary sexual intercourse of a married person with a person other than his or her spouse.” The outlet adds that the state appears to be saying that “emotional affairs, sending inappropriate text messages or spending time with another person are not, in and of themselves, considered legal adultery.”

According to the outlet, the couple’s two children, Vance, seven, and Westin, six, will be subject to conditions set by Kristy and Desmond in a “mutual written agreement regarding custody, visitation and support.” However, the filing reportedly added that if the two couldn’t agree on terms, Kristy would like the court to decide.

Additionally, the filing claims the couple has a “marital property agreement.” The document would indicate who will leave with what property, “both community and separate”. Additionally, the two have yet to decide how they will share their “community estate,” which appears to refer to their newly built “dream home.”

As for whether her name will be “Kristy Scott” in the future, Kristy is reportedly changing things up. She reportedly asked the court to change her name back to “Kristy Small.” Finally, she also asked Desmond to pay her attorney fees and court costs.
