In a surprising development in the case of a stab of Saif Ali Khan, the accused intruder, Mohammad Sharul Islam – allegedly a national Bangladais – has now filed a plea claiming that his arrest was illegal. According to a PTI report, Islam lawyer Ajay Gawli submitted a advocacy to the first class judicial magistrate to Bandra, declaring that the arrest had been made in clear violation of article 47 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

The advocacy argues that the arrest was “clearly and obvious” by the authorities investigating, because Islam would not have been informed of the reasons for its arrest or provided any information on its right of deposit – which are both legal requirements under BNSS, revealed that the request submitted to the Court.
In addition, the advocacy said that no official written document of charges was given to the accused at the time of the arrest, adding that the mandatory procedural directives were ignored. The legal advisor to Shriful Islam said that such supervisors question the legality of the arrest not only, but also violated the fundamental rights of the accused. Following the submission of the plea, the court ordered the police to respond to the plea and the case was also adjourned on May 13.
This legal turn adds to the already sensational case involving the actor of Bollywood Saif Ali Khan, who was attacked at his residence in the early hours of January 16. According to previous reports, the accused had intrusion into the house of Bandra de Khan and tried to stab the actor with a clear object. Saif suffered several injuries as he tried to defend himself and his family, after which he was immediately transported to the neighboring Lilavati hospital to be treated.
The case has aroused wide attention from the media and a public interest due to the popularity of the actor. And now, with new legal challenges emerging from the accused’s camp, all eyes are now at the hearing of May 13.
