Wednesday, the High Court of Delhi set aside a provisional injunction which had retained the composer Ar Rahman and others to use the song ‘Veera raja veera ‘ From Mani Ratnam’s film in 2023 Ponniyin Selvan II. A judge division of judges C Hari Shankar and OM Prakash Shukla adopted the order while hearing the appeal of Rahman against a single judge decision. “We have authorized the appeal. We wrote simultaneous opinions. We put aside the order disputed by the single judge in principle,” observed the bench.

The judges, however, said that they did not examine the real question of the violation of copyright at this stage.

Context of the case

The dispute occurred after the classic singer and winner of Padma Shri Ustad Fayaz Wasifuddin Dagar filed a complaint to copyright against Rahman, Madras Talkies, Lyca Productions and Tips Industries. Dagar alleged that Veera Raja Veera was copied from Shiva StutiA classic composition created in the 1970s by his father Ustad Nasir Faiyazuddin Dagar and the uncle Ustad Zahiruddin Dagar, popularly known as the Juniors Dagar brothers.

Traced days Shiva Stuti to several international performances, notably at the Royal Tropical Institute of Amsterdam in 1978, and noted his inclusion in the album Shiva Mahadeva. He affirmed that as a holder of the rights of the compositions of his father and uncle, the version of Rahman violated his copyright.

Judge Prathiba M Singh of the High Court of Delhi had previously ruled in favor of Dagar, observing that ‘Veera raja veera ‘ was “not just based on or inspired by Shiva Stuti But identical … with a simple change in the words. Following this, a provisional injunction was delivered against Rahman and the other defendants.

Allegations and defense

In his trial, Dagar asked for an appropriate credit on platforms and an injunction against the continuous use of the composition of Rahman. He also told court that Rahman had assured him once on a telephone call that he would try to resolve the problem, but no follow -up took place.

The defendants, however, strongly disputed the allegations. Madras Talkies described affirmations as “poorly designed” and argued that ‘Veera raja veera ‘ was based on a traditional song, accusing Dagar of looking for advertising and financial advantages. TIPS Industries also argued that copyright could not extend to the “way of singing” or the style of surrender.

Current state

The division bench binding the provisional injunction, Rahman and the producers are no longer retained to use ‘Veera raja veera ‘. However, the more important question of knowing whether the song is equivalent to the violation of copyright is not resolved and should be addressed in the following procedure.
