Bessent announces end of federal tax credits for illegal immigrants

Bessent’s message alluded to an announcement by the Treasury Department last week that it would propose new regulations clarifying that the refundable portions of these tax credits are “federal public benefits” to which illegal immigrants and unqualified aliens are not entitled.

Bessent added in a subsequent post: “If you are here illegally, there is no place for you in our financial system.

“Illegal aliens using our financial institutions to move their illegally obtained funds is exploitation, and it will end.”

This decision follows a recent legal opinion from the Ministry of Justice Office of Legal Counsel, which adopted this interpretation.

Treasury’s announcement said it expects its final regulations to apply beginning in fiscal year 2026.

“The Treasury Office of Tax Policy and the Internal Revenue Service “We have worked tirelessly to advance this initiative and ensure its successful implementation,” Bessent said in the release. “Their diligence and professionalism reflect this administration’s determination to maintain the integrity of our tax system.

“We will continue to ensure that taxpayer resources are directed only to those entitled to them under the law.”

The Treasury’s Financial Crimes Enforcement Network (FinCEN) announced Friday that it is issuing an alert to financial institutions to prevent illegal aliens from exploiting the U.S. financial system by traveling illegally obtained funds.

The announcement states that money services businesses (MSBs) are generally required to file a suspicious activity report for a transaction involving at least $2,000 and that MSBs know, suspect, or have reason to suspect that it is relevant to a possible legal or regulatory violation.

These transactions include the cross-border funds transfer derived from illegal employment or otherwise obtained illegally in the United States

Bessent posted after Trump said Thursday that his administration would “permanently suspend” migration from all “third world countries” after a National Guard member was killed in an attack near the White House.

The comments mark a further escalation of migration measures ordered by Trump since Wednesday’s shooting, which investigators say was carried out by an Afghan national who entered the United States in 2021 as part of a resettlement program.

Trump did not identify any countries by name or explain what he meant by third world countries or “permanent pause.” He said the plan would include cases approved during former President Joe Biden’s administration.
