How Cassie’s testimony has an impact

While Cassie’s testimony alone has not entirely discussed the accusations that Diddy is confronted, the question of whether the consent was really present can remain at the back of the jury’s mind.

Everything may seem humiliating and all this may seem very disturbing, but if she was a voluntary participant or if these other people were voluntary participants, then we really do not have the elements of a crime here,” said Ritter. “Now the defense, I think, has done a very good job by describing the text conversations she had with combs during and after several of these monsters.”
Ritter added that the prosecution team should say that being an alleged “voluntary participant” was “part of the abuse cycle”.
“The accusation will then have the burden of showing the jurors how it is and how many times the victims of abuse will even participate shocking or seem to participate in their abuse,” he said. “And I probably think that the proof that we have seen which is the most demonstrative is the video band of the assault which took place at the hotel here in Los Angeles. I imagine that the prosecutors will say that it shows someone who tries to escape, who shows someone who tries to withdraw from the situation and to beat him physically and to bring her back in his own way.”
This argument will be difficult to make, warned Ritter.
“If someone suffers from this kind of abuse, he will say very surprising things and perhaps things that are difficult to understand, like text messages that might seem that she participates,” he continued. “It will be an argument that will certainly be something that the pursuit will probably have the most difficult time, it is how you show that these people did not agree and vocalized that they did not agree? Because even if they do not consent, but which did not take place in their own head, it is not enough to satisfy the elements of non-consensible sexual assault.”
Diddy’s arrest occurred almost a year after Cassie brought legal action accusing her ex of sexual and physical violence throughout their relationship. Diddy denied his claims in a statement shared by his lawyer.
